GARY LEWIS SUCCESFUL IN HIGH COURT CONTEMPT PROCEEDINGS


The judgment of His Honour Judge Pearce (sitting as a Judge of the High Court) has been published arising out of the important case of Advantage Insurance v Shaw EWHC [2026] 2188 (KB) in which Gary Lewis, led by Ben Bradley KC and instructed by Marc Livingstone, acted for the successful respondent.

An insurer's application for permission to commence contempt proceedings - arising out of what is believed to be the highest ever valued claim dismissed on the basis of fundamental dishonesty - was struck out as an abuse of process. It was found that the insurer had pursued the application without the authority of the insured. Indemnity costs were also awarded.
