Notable Cases

E v L [2025] – Appeal hearing following a strike out of the Claimant’s case. Eduard represented the Claimant/Appellant. The appeal was made on 3 grounds. Eduard succeeded on the first ground and the matter was reinstated to proceed to trial. The second and third grounds were not pursued as all grounds aimed to overturn the decision of the lower Court to strike out. The ground upon which the appeal was allowed dealt with the erroneous interpterion of section 69 of the Solicitors Act 1974 by the Court below.

Cooley v Polycorr Limited [2025] – Employer’s liability claim arising from a complex injury in the workplace. Eduard represented the Claimant. The Circuit Judge preferred the Claimant’s evidence, referred to the excellent closing submissions put forward by Eduard, and accepted the questions put to the Defendant’s witness in cross examination which, as the Learned Judge said, the witness was not able to answer positively considering his managerial position in the Defendant’s company. Judgment was handed down for the Claimant.

Fannon v Asda Stores Limited [2026] – Road Traffic Incident in which breach of duty was admitted. Eduard represented the Defendant. Quantum was in dispute. The Claimant sought an award in excess of £13,000.
