Eduard Antanian successfully opposes specific disclosure application and judge awards costs in the case.

The case arises from a road traffic collision which has caused serious injuries and losses to the Claimant, and it has been valued at £1.2 million.

The Defendant made an application for specific disclosure and variation of directions.

The Claimant opposed the specific disclosure aspect of the application but consented to the variation of directions part.

Eduard successfully opposed the application by establishing that most of the documents sought had already been provided back in November 2024. Any further documents sought were either not in the Claimant’s control or they didn’t exist. Either way C had complied with their duty of disclosure and D’s contentions in support of their application were materially incorrect on the evidence before the Court.

HHJ Harrison agreed that the Claimant had succeeded in the application and awarded costs.
