Emily Fildes successfully opposed an application for leave to issue an application for a child arrangements order made by the child’s biological maternal aunts. Emily represented the second respondent psychological / non-biological parent with whom the child is living subject to a Child Arrangements (Lives with) Order in their favour after previous lengthy public law proceedings.
Emily directed the court to its conclusions during the previous court proceedings, the length of the time that the child had been the subject of court proceedings, the impracticalities of such an application and the asserted potential risks to the child’s stability and welfare were leave to be given.
The proceedings have concluded with an order refusing leave.
A member of the press was present during the hearing and a Transparency Order was made to permit anonymised reporting of the matter.
