Gary Lewis Successful in Bounce Back Loan Fraud Case


On 6 August, Gary Lewis appeared at trial in the Business and Property Courts in Manchester on behalf the Secretary of State for Business and Trade in respect of a contested directors disqualification claim, instructed by the Insolvency Service.

The Secretary of State alleged that a director of three companies carrying on cryptocurrency businesses had knowingly overstated turnover figures in respect of three bounce back loan applications made in May and June 2020. 

The director defended the claim on the basis that the completed online forms differed to those subsequently disclosed by the bank and he had therefore provided estimated turnover figures. 

Gary persuaded the court to reject that defence and to find that the director knew that the actual turnover figures were required and had knowingly overstated the same. Further and in either event, the court was persuaded that even if the figures provided were estimates, they too had been knowingly overstated.

As a result of which, the court accepted that the allegations fell into the most serious bracket of cases and granted a 12-year disqualification order together with costs.
