Lucy Hemsworth secures an 85% deduction in vehicle damages claimed, and no order as to costs.


Lucy, instructed by Keoghs on behalf of the Defendant, succeeds in rebutting the Claimant’s evidence in a quantum only Fast Track Trial.

The Claimant relied on an audetex report and an invoice for their repairs claim, totalling £12,000 for light damage. The audetex report crucially showed no breakdown for the cost of labour, parts, or a total for the repairs, no assessment notes, and part of the report had been redacted. Lucy was successful in not only showing the discrepancies in the report, but highlighting to the Judge what should be expected in a breakdown of labour costs. The invoice similarly provided no breakdown.

The Defendant obtained a report of their own, and Lucy was able to compare and contrast both reports forensically, leading the Judge to the conclusion that the Claimant’s Audetex was insufficient, highlighting the usefulness of rebuttal quantum evidence.

The Judge awarded the Defendant’s figure for repairs which came to under £2,000, an 85% saving.

Further, on costs, Lucy was successful in persuading the Judge to not award any fixed Fast Track costs for the Claimant, in light of the difficulties with the Audetex report. The Defendant secured a 100% saving in costs.
