On 25 September 2025 HHJ Davies handed down a comprehensive Judgment following a five-week Trial in the Technology and Construction Court, in which he found for the Defendant on the Stage One issues, concluding that the 16 Test Claimants had not suffered nuisance. The case was made the subject of a Group Litigation Order in 2017 and had a lengthy and complex case management history, which included the Senior Master revoking permission for the Claimants to rely upon evidence from an expert witness due to irregularities in the joint statement process. Michael cross-examined the Test Claimants whose evidence the Judge found to be largely unreliable.
