Mussadak Mirza successfully acted for the 93 year-old Claimant / Respondent in the appeal in Jeffrey Harmer v Hodges Locks Ltd, SWS Ltd and Goldstar (B’ham) Ltd.
Mussadak had succeeded in a contested trial on the issue of limitation in a historic NIHL claim relating to employment going back to the mid-1960s. Having found the claim to have been brought out of time under s.14 of the Limitation Act, Judge Witherington exercised her equitable discretion under s.33 to disapply the limitation period against all three Defendants.
The Defendants appealed the decision on three grounds. After hearing submissions, His Honour Judge Boora, sitting at the County Court in Walsall, refused permission to appeal on all grounds. Mussadak was instructed by Rebecca Bennett of Baker & Coleman Solicitors.
