Richard Oughton Succeeds in an Important Case Concerning Equitable Notice and Overriding Interests

In Rock Ferry Waterfront Trust v Pennistone Holdings Limited [2020] EWHC 3007 (Ch) acted for purchasers of a substantial area of land who successfully resisted the claims of a previous purchaser who had deliberately chosen not to register a Transfer of registered land to have priority. The previous purchaser advanced claims based upon equitable notice and having an overriding interest through actual occupation, but His Honour Judge Hodge QC (sitting as a Judge of the High Court) rejected them:
